1. Introduction

By registering for an account or processing transactions through DeshiPay.xyz, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you must discontinue the use of our services immediately.

2. Definitions

  • "Service" refers to the payment processing, API, and gateway solutions provided by DeshiPay.xyz.
  • "User" or "Merchant" refers to any individual or business entity utilizing our platform to process payments.
  • "Transaction" means the digital transfer of funds facilitated through our gateway.

3. Acceptance of Terms

Your continuous usage of the DeshiPay.xyz network constitutes your absolute acceptance of these terms, including any updates or patches deployed to this agreement in the future.

4. Eligibility

To operate on our platform, you must be at least 18 years old and possess the legal authority to form binding contracts. Businesses must be legally registered and compliant with local jurisdictions.

5. Account Registration

Users must provide accurate, current, and complete data during the onboarding process. You are solely responsible for maintaining the strict confidentiality of your authentication credentials (passwords, API keys, and tokens).

6. Payment Services

DeshiPay.xyz acts as a technical intermediary connecting merchants with financial institutions. We ensure secure data transmission but do not act as a bank or hold user funds longer than the settlement window requires.

7. User Responsibilities

  • Maintain robust security protocols on your own servers and applications.
  • Provide accurate delivery of digital or physical goods purchased via our gateway.
  • Respond to chargebacks, disputes, and customer queries promptly.

8. Prohibited Activities

Our API and gateway must not be used to process transactions for illegal goods, gambling, adult content, unauthorized cryptographic assets, or any activity that violates anti-money laundering (AML) protocols.

9. Fees and Charges

DeshiPay.xyz charges processing fees per transaction as outlined in your specific merchant agreement or our pricing page. Fees are automatically deducted from the settlement payload before funds are deposited into your account.

10. Refund & Cancellation Policy

Merchants hold the primary responsibility for issuing refunds. DeshiPay.xyz facilitates the routing of refund data back to the issuing bank. Processing fees applied to the original transaction are non-refundable.

11. Intellectual Property

All source code, UI designs, logos, and proprietary algorithms associated with DeshiPay.xyz remain our exclusive intellectual property. Reverse engineering or unauthorized replication of our frontend or backend architecture is strictly prohibited.

12. Privacy

Our data collection and processing methodologies are strictly governed by our Privacy Policy. By using our services, you consent to the cryptographic storage and transmission of data as outlined in that document.

13. Limitation of Liability

DeshiPay.xyz ensures maximum uptime (SLA), however, we are not liable for server downtimes, network latency, or financial losses resulting from third-party ISP failures, cyber-attacks, or unauthorized access due to merchant negligence.

14. Indemnification

You agree to indemnify and hold DeshiPay.xyz harmless from any claims, damages, or legal fees arising from your breach of these terms, fraudulent transactions, or violation of local statutory laws.

15. Suspension & Termination

We reserve the right to suspend or permanently terminate API access and merchant accounts without prior notice if algorithmic anomaly detection flags fraudulent activities, excessive chargebacks, or breach of these terms.

16. Third-Party Services

Our platform may integrate external APIs (e.g., SMS gateways, KYC verification systems). We hold no liability for the operational stability or policy changes of these third-party nodes.

17. Governing Law

These terms shall be governed by and interpreted in accordance with the standard cyber and financial laws of Bangladesh. Any dispute resolution will be subject to the exclusive jurisdiction of the local courts.

18. Changes to Terms

We may push updates to these terms dynamically. Continued use of the platform after an update is deployed implies consent to the modified parameters.
